Avanti Rent a Car, hereinafter Avanti, is a company based in Costa Rica, owner and administrator of the website www.avantirentacar.com, a virtual site dedicated to online vehicle rental.

The USER who wishes to access and/or use the website www.avantirentacar.com expressly declares that they have read and accepted this TERMS OF USE AGREEMENT, together with all other policies and principles that govern the site www.avantirentacar.com and that are incorporated into this Agreement by reference. All of the above is mandatory and binding between Avanti and the USER who makes use of the website. If the USER does not agree with this document, they will not be able to access and/or use the website www.avantirentacar.com

For the purposes of this TERMS OF USE AGREEMENT, the following clauses, declarations, and concepts are developed and defined below, regardless of whether they are used in singular or plural form:

Avanti: Virtual platform that allows the user to rent cars online, hereinafter referred to as Avanti.

USER: Any natural person, of legal age, who enters www.avantirentacar.com to navigate the site and/or rents a vehicle online. It is presumed that the USER has the sufficient mental and legal capacity to acquire PRODUCTS by means of credit or debit card payment.

PRODUCT: Rental of used vehicles.

ORDER NUMBER: Numbering that will be used to control the PRODUCTS purchased by the USER at www.avantirentacar.com

Registration account:

Avanti website is free, the amounts to be collected apply only if the user decides to contract the service provided by Avanti. The USER must be at least eighteen (18) years old to accept and establish this binding TERMS OF USE AGREEMENT in his name, the foregoing through a registration account where he will enter personal data and thus have access to the website www.avantirentacar .com

The account that a USER registers with Avanti is unique, personal, and non-transferable. The USER undertakes to periodically review the information provided and guarantee the validity and validity of the data associated with his registration account. Avanti will take said information as valid and based on said data, it will proceed to notify and deliver the PRODUCTS that the USER acquires in Avanti.

Avanti has not reviewed all of the information contained on other Web sites and Avanti is not responsible for the content of other Web sites or for any products or services that may be offered through other Web sites. Third-party websites may contain information with which Avanti agrees or does not agree. Different Terms and Conditions may be applicable to the use by any of said connected sites.

Avanti’s sole discretion, it may close, suspend or restrict a USER’s access to their registration account in the event that the USER violates this TERMS OF USE AGREEMENT and/or any other policy that exists on the website www.avantirentacar .com

Payment of PRODUCTS:

When purchasing a PRODUCT, the USER must pay the published price. The USER accepts the form of payment and the procedures established by Avanti for the acquisition of the PRODUCTS offered on the website www.avantirentacar.com. The price of the PRODUCTS published in Avanti will be displayed in US dollars.

Avanti guarantees that the transactions carried out by the USER within the website www.avantirentacar.com are safe and backed by an international security certification.

Avanti undertakes with the USERS that the personal information and bank details provided are confidential and for exclusive use, the personal information and card details are used only to complete the transaction at www.avantirentacar.com, therefore that USERS can be safe and calm when handling it. The USER accepts that, when acquiring PRODUCTS in Avanti, it is subject to the availability and quantity previously established by Avanti.

Responsibility:

Avanti undertakes to indicate the price, guarantee, availability, and characteristics of each PRODUCT sold on the website www.avantirentacar.com

Avanti will establish the following email sales@avantirentacar.com available to the USER, intended to receive queries, suggestions, comments, and/or complaints that the USER may have related to the operation and management of the system, in order to optimize its operation.

To the fullest extent permitted by applicable law, the USER understands and agrees that neither Avanti nor any of its subsidiaries or affiliates or third-party content providers will be liable for any direct, indirect, incidental damages related to or resulting from its use or its inability to from using this site or any other site that the USER accesses through a connection from this site or from any action that Avanti takes or stops taking as a result of email messages that the USER sends to them. These include damages for errors, omissions, interruptions, defects, delays, computer viruses, lost profits, loss of data, unauthorized access to and alteration of your transmissions and data, and other tangible and intangible losses.

Intellectual property:

The material and content on the website www.avantirentacar.com are protected under the current and valid legislation of Costa Rica and international conventions regarding intellectual property rights. The USER expressly acknowledges and accepts that the use of material or content published in Avanti is not permitted for commercial purposes or other purposes not described in this TERMS OF USE AGREEMENT, therefore, the USER may not copy, download, market, modify, publish, distribute, create works or exploit in any other way without the prior written permission of Avanti.

The content of Avanti is solely for the purpose of marketing PRODUCTS. In the event that the USER needs specific advice on the promoted PRODUCT or its use, they can write directly to sales@avantirentacar.com with the reason: advice, and right there you will be helped. Avanti is not responsible for any use or decision that the USER makes based on the information displayed on the website www.avantirentacar.com

System failures:

The USER acknowledges that there may be interruptions to the website www.avantirentacar.com, due to circumstances, both within and outside the control of Avanti.

In the event of technical problems, or failures in the system or in the internet service, it will not guarantee continuous or uninterrupted access and use of the website www.avantirentacar.com, however, it will make reasonable efforts to remain active.

Avanti will not be responsible for any virus that could infect the USER’s equipment as a result of access and/or use of it, the above as a result of any transfer of data, files, images, texts, or any improper use of the information displayed on Avanti.

The USER may not impute any responsibility or require Avanti to pay for lost profits or consequential damages, by virtue of damages resulting from technical difficulties or failures in the systems or on the Internet.

Contract modifications

Avanti may at any time and when it deems appropriate, without the need to notify the USER, make corrections, additions, improvements, or modifications to this TERMS OF USE AGREEMENT. Said modifications and/or adaptations will be applicable to the USER from the moment of its publication in Avanti. It is the responsibility of the USER to periodically review the TERMS OF USE AGREEMENT, PRIVACY POLICY, and RETURN POLICY in order to keep abreast of said updates. Notwithstanding the foregoing, each time the USER accesses the website www.avantirentacar.com it will be considered as an absolute acceptance of the modifications of the mentioned documents.
